Lockyer Valley Regional Council (Consultation Notice No. 1) 2018

Making of proposed local laws

Lockyer Valley Regional Council ("Council") has, by resolution dated the 17th day of January 2018, proposed to make:

  1. Local Law No. 7 (Waste Management) 2018; and
  2. Subordinate Local Law No. 7 (Waste Management) 2018.

Local laws that authorise the subordinate local laws to be made

Subordinate Local Law No. 7 (Waste Management) 2018 is made pursuant to Local Law No. 7 (Waste Management) 2018.

Purpose and general effect

The object of Local Law No. 7 (Waste Management) 2018 is to protect the public health, safety and amenity related to waste management and to prevent and combat the spread of pests and disease within its local government area by:

  1. regulating the storage, servicing, collection and removal of waste; and
  2. regulating the disposal of waste at waste facilities; and
  3. ensuring that an act or omission does not result in:
  1. harm to human health or safety or personal injury; or
  2. property damage or loss of amenity; or
  3. environmental harm or environmental nuisance; and
  1. enabling Council to take enforcement action for contraventions of this local law.

The purpose of Subordinate Local Law No. 7 (Waste Management) 2018 is to assist in the implementation of Local Law No. 7 (Waste Management) 2018.  The purpose is to be achieved by providing for matters as prescribed by the authorising local law.

Public Consultation

Written submissions by any person in support of, or objecting to, a proposed local law are invited starting on Wednesday, 11 April 2018 and ending on Wednesday, 2 May 2018 inclusive.

During the consultation period Council will make available for inspection and purchase at Council's public offices at 26 Railway Street, Gatton and 9 Spicer Street, Laidley a copy of the proposed local laws.

These documents will also be available on Council's website: www.lockyervalley.qld.gov.au.

Submissions

Submissions must be received on or before 5pm on 2 May 2018 stating:

  1. the grounds of the submission; and
  2. the facts and circumstances relied on in support of the grounds.

Submissions can be lodged:

  1. by email to cbischoff@lvrc.qld.gov.au
  2. by mail to PO Box 82, Gatton Qld 4343; and
  3. in person at Council's office at 26 Railway Street, Gatton.

Submissions should be clearly marked "Submission – Proposed Waste Management Local Laws".  If submitting electronically, please include this heading as the email subject line.

Making of local law

Lockyer Valley Regional Council ("Council") has, by resolution dated the 28th day of February 2018, made Amending Subordinate Local Law No. 1 (Miscellaneous Subordinate Local Laws) 2017.

Local laws that authorise the subordinate local laws to be made

Amending Subordinate Local Law No. 1 (Miscellaneous Subordinate Local Laws) 2017 is made pursuant to:

  1. for Part 2, Local Law No. 2 (Animal Management) 2011; and
  2. for Part 3, Local Law No. 5 (Parking) 2011.

Subordinate local laws amended

Amending Subordinate Local Law No. 1 (Miscellaneous Subordinate Local Laws) 2017 amends the following subordinate local laws:

  1. Subordinate Local Law No. 2 (Animal Management) 2011.
  2. Subordinate Local Law No. 5 (Parking) 2011.

Purpose and general effect

The purpose and general effect of Amending Subordinate Local Law No. 1 (Miscellaneous Subordinate Local Laws) 2017 is:

  1. in Part 2, to amend Subordinate Local Law No.2 (Animal Management) 2011 to:

(i)    provide clarity and certainty in relation to when an approval for the keeping of animals in Item 3 of Schedule 2 is required;

(ii)   ensure that the minimum requirements for keeping of these animals in Item 2 of Schedule 5 applies consistently to these types of animals; and

(iii)  describe a dog off-leash area.

  1. in Part 3, to amend Subordinate Local Law No.5 (Parking) 2011 to identify declared traffic areas and provide for the issue of parking permits to recognised business operators engaged in temporary business activities.

Consolidated version of local law

Council has, by resolution dated the 28th day of February 2018, adopted a consolidated version of each of:

  1. Subordinate Local Law No. 2 (Animal Management) 2011, and
  2. Subordinate Local Law No. 5 (Parking) 2011.

Inspection

Copies of the Amending Subordinate Local Law No. 1 (Miscellaneous Subordinate Local Laws) 2017 and the consolidated versions of each of Subordinate Local Law No. 2 (Animal Management) 2011 and Subordinate Local Law No. 5 (Parking) 2011 may be:

  1. inspected and purchased at Council's public office at 26 Railway Street, Gatton, and
  2. viewed by the public on Council's website and the website of the Department of Local Government.
